Consent to the Collection, Processing, Storage and Cross-Border Transfer of Personal Data

In accordance with the Law of the Republic of Kazakhstan “On Personal Data and Their Protection” and other regulatory legal acts of the Republic of Kazakhstan,
I hereby, acting freely, of my own will and in my own interest, give my informed consent for the purpose of registration and use of the “4Sell Cashier” Service to the collection and processing of my Personal Data, by methods not contradicting the legislation of the Republic of Kazakhstan, to MICA Limited Liability Partnership (BIN 250640030539, registered at: 48 Abay Street, premises 1, Karaganda, Karaganda Region, 100012, Republic of Kazakhstan), hereinafter referred to as the “Operator”.
This consent is granted for the collection, recording, systematization, accumulation, storage, clarification (updating, modification), use, extraction, transfer (provision, access), anonymization, blocking, deletion, destruction, cross-border transfer, as well as any other actions with Personal Data in accordance with the current legislation of the Republic of Kazakhstan in relation to my Personal Data for the following purposes:

• granting access to the “4Sell Cashier” Service and related services;
• fulfillment of the Operator’s obligations to the User;
• carrying out communications aimed at improving the quality of services provided;
• sending notifications, informational and promotional messages regarding new products and services;
• compliance with the requirements of the legislation of the Republic of Kazakhstan;
• internal control and accounting of the Operator;
• judicial and extrajudicial protection of the Operator’s rights, including in the event of breach of obligations and in the event of disputes, including disputes involving third parties.

Personal Data Processed by the Operator:

• Full name;
• Phone number;
• Email address.

Other Data Processed by the Operator:

• History of actions within the personal account;
• Access to the Company’s/Contact Person’s CRM system;
• List of employees;
• Sales funnels;
• Transaction data.

This consent is granted for the entire period of my use of the “4Sell Cashier” Service, as well as for the statutory data retention period established by the legislation of the Republic of Kazakhstan after termination of use of the Service.
I confirm that:

• this consent applies to all relations with the Operator, including those already existing and/or arising at the time of granting this consent, as well as to any other relations that may arise in the future, and remains valid both during my (the Data Subject’s) legal relations with the Operator and after their termination within the periods established by the legislation of the Republic of Kazakhstan necessary for the proper performance by the Operator of its rights and obligations imposed by such legislation;
• by this consent, the Operator is granted the right to independently determine the conditions of access of third parties to Personal Data;
• notification of the Data Subject is not required when the Operator collects, processes and transfers Personal Data across borders;
• this consent may be provided to third parties as evidence that the Operator possesses the necessary authority to collect, process and transfer the Data Subject’s Personal Data across borders;
• this consent may be withdrawn in cases provided for by the legislation of the Republic of Kazakhstan upon submission of a corresponding application by sending a letter to the email address support@4sell.ai, or by sending a written notice to the Operator at: 48 Abay Street, premises 1, Karaganda, 100012, Republic of Kazakhstan, delivered no less than 30 (thirty) calendar days prior to the date of withdrawal of this consent, or delivered in person to the Operator’s address.
• I am aware that, in accordance with the Law, this consent may not be withdrawn if such withdrawal contradicts the Law or if I (the Data Subject) have outstanding obligations to the Operator or third parties. In particular, pursuant to the requirements of the legislation of the Republic of Kazakhstan, withdrawal of consent applies to the collection, processing, storage and transfer of my Personal Data from the moment such withdrawal becomes effective and does not affect data collected, processed and stored by the Operator prior to such withdrawal and for 3 (three) years after the complete termination of my (the Data Subject’s) relations with the Operator.
• I understand that withdrawal of consent to the collection, processing, storage and transfer of my Personal Data may result in the impossibility of receiving services from the Operator, and I acknowledge that in such case the Operator shall be released from any liability to me for non-provision, partial provision or untimely provision of services from the moment of such withdrawal;
• I shall have no claims against the Operator regarding the collection, processing and cross-border transfer of my Personal Data in the future, provided that the Operator complies with the requirements of the Law and/or the conditions set forth in this consent;
• receipt of the Operator’s services from the moment I am informed of the necessity to provide such Consent constitutes my full and unconditional acceptance of the terms set forth herein;
• consent expressed in electronic form shall be deemed equivalent to consent provided by me (the Data Subject) in written paper form;
• in case of disagreement with the terms of this Consent to the collection, processing, storage and transfer, including cross-border transfer, of my Personal Data, I independently bear responsibility for refusal to use the Operator’s Service and receive its services.

This consent may be withdrawn in cases provided for by the legislation of the Republic of Kazakhstan upon submission of a corresponding application by sending a letter to the email address specified in the Privacy Policy and Personal Data Processing Policy.
